Terms of Use
The rules for using Eighteen2, written to be read. The short version: designs are budgetary, your data is yours, and Pennsylvania law applies.
The agreement
These Terms of Use govern your use of the Eighteen2 software and websites at eighteen2.com and service.eighteen2.com (the “Service”), provided by Eighteen2 (“we,” “us”). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use the Service for an organization, you agree on its behalf and confirm you are authorized to do so; “you” then includes that organization.
If your organization has signed a separate written agreement with us, that agreement controls where it conflicts with these terms.
Accounts
The Service is for business use by people 18 or older. Give accurate account information, keep your password private, and tell us promptly at contact.us@eighteen2.com if you think your account has been used without permission. You are responsible for activity under your account and for the people you invite to your organization’s account.
Trials, subscriptions, and billing
A new account may start with a free trial for the period shown at sign-up. No card is required for the trial. When it ends without a paid plan, the account becomes read-only; your data is not deleted.
Paid plans are billed in advance through Stripe for the term and seats you choose, and renew automatically until cancelled. You can cancel from your account; cancellation takes effect at the end of the current term. Fees do not include taxes, which are added where required. Except where the law requires otherwise or we agree in writing, fees already paid are not refundable. We will give at least 30 days’ notice of a price change before it applies to your next renewal.
Designs are budgetary
Eighteen2 produces budgetary designs for estimating and proposals. They are not stamped or sealed engineering, and they are not approved for construction. Sizing, parts lists, P&IDs, spec checks, and submittals are drafts based on the information entered and on published standards and manufacturer data, which can change or contain errors.
You are responsible for reviewing every output. A licensed engineer or the equipment manufacturer must confirm a design before it is built, installed, or relied on for patient care, laboratory results, or product quality. Standards are named for reference and belong to their publishers; part numbers and links point to third-party sites we do not control.
Your content
You and your organization own the project data you put into the Service. You give us permission to host, copy, process, and display it only as needed to provide and support the Service for you, and to create de-identified, aggregate statistics that do not identify you, your organization, or your customers.
You are responsible for having the right to enter the information you add, including your customers’ contact details and site photos, and for sharing project links only with people who should see them.
Customer confirmations
When a customer confirms a section or a return through a project link, the Service records what was confirmed and when, and can email a printable receipt. This is a record of confirmation for your workflow. It is not a legal electronic signature, a contract, or a purchase order, unless you and your customer separately agree to treat it as one.
Acceptable use
Do not:
- break the law, or infringe or misuse anyone else’s rights or data;
- try to get around access controls, probe for vulnerabilities, or interfere with the Service or other users;
- scrape, copy, resell, or reverse engineer the Service, except as the law expressly allows;
- upload malware, or send spam or unwanted messages through the Service;
- share your account or let more people use a plan than it covers.
We may suspend access that puts the Service or others at risk. We will tell you why when we reasonably can.
Our software
We own the Service, including its software, design, reference sheets, and catalog data, and our name and marks. These terms give you a limited, non-exclusive, non-transferable right to use the Service during your trial or subscription. If you send us feedback, we may use it without obligation to you.
Changes to the Service and these terms
We improve the Service continually and may change or retire features. We may update these terms; we will post the new version here with a new effective date and, for a material change, tell account holders in advance by email or in the Service. Continuing to use the Service after a change takes effect means you accept it.
Ending your use
You can stop using the Service and cancel at any time. We may suspend or close an account that materially breaches these terms or goes unpaid, after notice where practical. Before an account is closed, you can ask us for an export of your project data. Sections that by their nature should survive (such as ownership, disclaimers, liability limits, and governing law) survive the end of these terms.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any design or output is correct or complete.
Limitation of liability
To the fullest extent the law allows, Eighteen2 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from or related to the Service or these terms. Our total liability for all claims related to the Service or these terms is limited to the greater of the amounts you paid us for the Service in the 12 months before the claim arose, or one hundred U.S. dollars ($100).
Indemnity
You will defend and indemnify Eighteen2 against third-party claims arising from your content, your use of the Service in breach of these terms, or a design built or installed without the confirmation described above.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania and applicable U.S. federal law, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state courts located in Montgomery County, Pennsylvania, or the U.S. District Court for the Eastern District of Pennsylvania, and both parties consent to those courts’ jurisdiction.
General
These terms and the Privacy Policy are the whole agreement between you and us about the Service, unless a separate written agreement applies. If any part is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not assign these terms without our consent; we may assign them in a reorganization, merger, or sale. Neither party is liable for delays caused by events beyond its reasonable control.
